The Services provided by LibreBeat are subject to this Agreement and are only available for Users who reside in, are domiciled in, or are otherwise eligible to do business with, LibreBeat, as determined by LibreBeat.LibreBeat reserves the right to modify and update this Agreement from time to time. If we make any material changes, we will provide Users with notice of such changes in advance of their effective date. It is the User’s responsibility to make sure they are familiar with the most updated version of this Agreement.

4. Privacy Policy

LibreBeat endeavors to maintain the highest level of privacy and security in the processing of personal data, including but not limited to the collection, use, storage, transfer and processing of User’s personal data. 5. Intellectual Property

6. Refunds

All purchases of Services from LibreBeat are non-refundable.

7. Limitation of Liability

In no event will LibreBeat, or its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for any special, incidental or consequential damages. In addition, in no event will LibreBeat be liable for any loss of profits or any damages in excess of one hundred (100) Euros.

8. Warranty Disclaimer

LibreBeat disclaims any and all warranties, representations, and conditions, express or implied, relating to the Services, including but not limited to any warranty of merchantability, fitness for a particular purpose, and non-infringement.

9. Severability

If any provision of this Contract is found to be invalid, illegal or unenforceable, the balance of this Agreement shall remain in full effect and shall be construed in a manner that most closely reflects the intent of the original language.

10. Governing Law and Dispute ResolutionT

his Agreement and any dispute arising from or related to it shall be governed by and construed in accordance with the laws of the European Union. Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, shall be determined by arbitration in the European Union before one arbitrator. The arbitration shall be administered by the International Court of Arbitration of the International Chamber of Commerce in accordance with the rules of such organization then in effect.This Agreement grants powers and rights which may not be waived by implication or otherwise. No waiver of any provision of this Agreement shall be effective unless it is in writing and signed by an authorized representative of LibreBeat. No waiver of any of the provisions of this Agreement shall be deemed or shall constitute a waiver of any other provision (whether or not similar) nor shall such waiver constitute a continuing waiver unless otherwise expressly provided.
